February 13, 2023

The February 2023 Board of Directors Meeting of Delray Villas Plat 3 was held the above date at the Recreation Center Viking Room. The meeting was called to order at 7:00 PM by President Alan Schnelwar with a salute to the flag followed by a moment of silence and private prayer of choice….   

Roll Call:  Present:  President Alan Schnelwar, Vice President Paula Beberman, Treasurer Richard Chrzan, Secretary Robert Albertson, Directors Kenneth Bankler, Maureen Gilman, Barbara Quinto, Barry Schwarz, Ronald Smilowitz. 

Reading of Minutes:   The minutes of the January 9, 2023, meeting were read and accepted as read on a motion by President Alan Schnelwar second by Vice President Paula Beberman.

INTRODUCTION OF NEW RESIDENTS: None.

REPORTS OF OFFICERS AND COMMITTEES

TREASURERS REPORT: Treasurer Richard Chrzan reported the following balances as of January 3, 2023                                   

Professional Bank

Reserve Account   $ 66,496.76

Operating Account   $ 67,219.58

Income January 2023 $ 104,435.36

Expenses January 2023 $ 44,342.69

PRESIDENTS REPORT:  President Schnelwar reported one or two cable problems this month.

MAINTENANCE & INTERVIEWS:   President Schnelwar reported that we currently have one resident who has not paid their 4th quarter of 2022 and one foreclosure not paid for 4th quarter of 2022 and about 10 owners not yet paid for 1st quarter of 2023.

POOL:  Director Ron Smilowitz reported the fence around the pool equipment has been repaired.  The repair cost was under $100.  New entry ladder coverings have been installed. Gathering estimates for recovering of the chairs at the pool. Report of pool gutters not being properly cleaned. This will be addressed with the pool cleaning vendor.  The temperature of the pool is stable.

LAKES:  Director Ken Bankler reported the usual algae treatment was applied and the weeds along the shoreline were sprayed.

ARCHECTURE: Ken Bankler reported one request for replacement windows and one request for a water filtration system. A discussion followed on the installation of outside water systems.  Where can the system be installed as it needs to be partially buried. End units appear to not be a problem.  The system would have to be hidden by bushes or some kind of plantings. What about residences that have the water valve inside the porch.  

GRIEVANCE:  Director Barry Schwartz reported three different outside lights are out. No problems with garbage.

PEST CONTROL:  President Schnelwar reported that Marie Cuillerier has volunteered to administer the Pest Control reports.

LANDSCAPE: Landscape Chairman Bob Albertson reported that he has investigated the problem of the very tall Australian Pine trees on the property at the even number side at the rear of Lucy Dr.  Those trees were planted before county ordinance was adopted and therefore are grandfathered.  Waiting for county on information on ownership of ficus trees along Atlantic Ave.   Lawn issue on the odd number side of Doris Ct. is caused by a wiring problem in our sprinkler system. 

SPRINKLERS: Director Barbara Quinto reported 2 issues on Lucy Drive and 2 issues on Candy Way.  One issue on Lucy Dr. is ongoing.

ROADS:  Director Maureen Gilman reported nothing new.     

ALLIANCE:  Secretary Bob Albertson reported that he went to The recent Alliance open house which was very informative. Next Alliance meeting will be Wednesday March 1, 2023. 

RECEATION ASSOCIATION: Recreation Association Delegate Iris Schnell reported that the Association Treasurer has stepped down and Fran Costa has been appointed as the replacement.  A committee consisting of board members from all 4 plats is working on revisions to the Association documents.  The inside framing at the A Building has been completed. They are now working on the electrical and sound systems.  Current target date for completion is possibly the end of Spring.  The Association is having a wine tasting on March 17th for any who are interested. Tickets are available every Thursday and Saturday in the Office at the B building. 

UNFINISHED BUSINESS:  Director Maureen Gilman reported that changing of the street lights in not even feasible.  The cost is close to $35,000. 

President Schnelwar reported on the sale of our 3 lots. He along with our Vice President met with the potential buyers and the buyers are very much interested and did not try to change the cost of the sale. The final timeline will have to be approved by the Plat 3 Board before anything is signed.  Some items are still under negotiation. A non-refundable deposit is unlikely.  Since the prospective buyers will be flying back to Poland shortly, there will be another meeting before they leave.  Some discussions will be conducted via email.  The buyers are looking that if the sale does not happen that they have the ability to sell the property and the new buyer is subject to Plat 3 original stipulations.  Plat 3 might be subject to income taxes on the sale of the property. 

Director Ron Smilowitz feels that the Board should examine the legitimate need for service dogs.  President Schnelwar reiterated that it is against the law to interfere with Service Dogs and Emotional Support Animals. With regards to Service and emotional support dogs, if you identify a resident you believe is violating our rules, then they will be sent a letter and subject to our rules and possible fines. 

NEW BUSINESS:  President Schnelwar advised all that one of our residents of a 4 unit building is having an issue with rodents in the attic.  Hulett Pest Control was contacted and they will treat only if all 4 units agree to the treatment.  Initially, one homeowner would not agree.  Now all for units will contract with Hulett and the treatment will be fully guaranteed. 

President Schnelwar advised that our new amendments call for background checks on renters and new homeowners.  We are waiting for our attorney to supply us with names of Companies who will conduct background checks.  This may necessity of us increasing our application fee to $150. A new purchase agreement and a rental agreement will be in order.  We may be rejecting people on that basis.  Plat 3 cannot control what fee an owner charges but, the renter still must pass all our background checks and complete rental agreement and pay rental fees.

President Schnelwar reported that we currently have an owner who is renting a room within their residence which is a violation of our documents.  After discussion the Board of Directors in attendance unanimously are in favor of sending the owner of the residence who is renting a room in her residence to have their current renter vacate by March 30, 2023.

President Schnelwar is asking for the Board of Directors to approve the Audit results for financial year 2022 as submitted by Gladstone and Company, Certified Public

Accountants. The record to reflect “We have consulted with the CPA and attorney, and after confirming that we are not a “statutory reserve” community, the CPA will reflect usage of reserve funds to offset operating expenses and will adjust the interfund balance accordingly.” The Board of Directors voted unanimously in favor to approve the audit results.

There was a suggestion that the Board obtain a line of credit should the need arise.  No action was taken.

GOOD AND WELFARE:   Delegate Ron Smilowitz spoke about the condition of our flagpole at the Plat entry.  The pole might need to be replaced. 

Inquiry as to possible increase to the size of our parking lot.  Possible removal of old shuffleboard court. This would still require double parking of cars.    

With no further business to conduct, the meeting was adjourned at 8:10 PM. The next Meeting will be a Plat 3 Board Meeting and will be Monday, March 13, 2023 at 7 PM in the Viking Room.

Attendance:  9 Board Members.  13 Residents.

The next Recreation Association Meeting will be March 15, 2023 at 7 PM. in the Viking Room. That meeting will be limited to 50 people including the Recreation Assoc. Board.  That meeting will also be broadcast using the ZOOM application.
